Please read these Terms of Service ("Terms") carefully before using the AquaDeck mobile application (the "Service") operated by AquaDeck ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You may sign in using email and password, Sign in with Apple, or Sign in with Google. You are responsible for maintaining the security of your chosen authentication method and for any activities or actions taken under your account.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
After you create an AquaDeck account, we may grant a limited welcome period during which Pro-level features (including cloud synchronization of your aquarium data) are available without a paid subscription. The duration begins from your account creation time as recorded in our systems and as shown in the Application (approximately thirty days unless we state otherwise).
This welcome access is tied to your account, not your device reinstall. Legacy accounts missing this information may receive a comparable window determined from account creation timestamps. Welcome access is separate from any free trial or introductory price offered through the Apple App Store or Google Play when you subscribe to AquaDeck Pro.
When your welcome period ends without an active AquaDeck Pro subscription, the Application may switch to read-only mode: you can browse your most recent tank data, charts, and use aquarium calculators, but editing, cloud sync, and adding tanks require a subscription. Subscribe or restore a qualifying purchase to regain full access.
AquaDeck offers an optional premium subscription service ("AquaDeck Pro") that provides access to enhanced features including cloud synchronization across your devices, unlimited aquariums and custom water parameters, photo timeline, species and inventory tools, task reminders, expense tracking where available in the Application, and data export — subject to the features actually offered in the version you use.
Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless canceled at least 24 hours before the end of the current period. You will be charged through your Apple App Store or Google Play Store account.
You may cancel your subscription at any time through your App Store or Play Store account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to Pro features until that time.
Upon cancellation, we may retain your cloud-stored data in accordance with our Privacy Policy so you can resubscribe or export where the Application supports it. To regain full editing and Pro feature access, you must reactivate your subscription or qualify under the account welcome access rules if any apply.
The App Store or Google Play may offer a free trial or introductory price for AquaDeck Pro. Terms, duration, eligibility, and price are determined by the store and displayed at purchase. If you do not cancel before a free trial ends (where applicable), you may be charged the subscription fee. You can cancel or manage auto-renewal in your store account settings, generally at least 24 hours before renewal, as described at purchase.
We reserve the right to modify subscription prices at any time. Price changes will take effect at the start of the next subscription period after notice is provided. Continued use of the Service after a price change constitutes acceptance of the new price.
You retain all ownership rights to the content and data you create in AquaDeck, including tank information, measurements, maintenance logs, photos, and other user-generated content ("Your Content").
By using our Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing and improving the Service.
If you do not have an active Pro entitlement and are not within an applicable welcome access period as shown in the Application, your aquarium data may be limited to local storage on your device for those modes; we do not sync that local-only copy to our cloud in that state.
With an active AquaDeck Pro subscription (or during your welcome access when Pro-level cloud features are enabled), your data may be stored in secure cloud storage (Google Firebase Firestore and related Firebase services) to enable synchronization and backup across devices.
You can delete your account and all associated data at any time through the Settings screen. This action is permanent and cannot be undone. Upon account deletion, all your cloud-stored data will be permanently removed from our servers.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of AquaDeck and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AquaDeck.
Our Service may contain links to third-party web sites or services that are not owned or controlled by AquaDeck. AquaDeck has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
In no event shall AquaDeck, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
